Ferrari says it will not take part in the 2010 FIA Formula 1 World Championship until the conditions of its entry are satisfied, despite the fact that the FIA has included the team on the official entry list.
“Ferrari submitted on 29 May 2009 an entry to the 2010 FIA Formula 1 World Championship which is subject to certain conditions. As of today, these conditions have not been met,” the team said in a statement. “Notwithstanding this and despite Ferrari’s previous written notice to the FIA not to do so, the FIA has included Ferrari as a unconditional participant in next year’s Formula 1 World Championship. For the avoidance of any doubt, Ferrari reaffirms that it shall not take part in the 2010 FIA Formula 1 World Championship under the regulations adopted by the FIA in violation of Ferrari’s rights under a written agreement with the FIA.”

So it appears the basis of the FIA’s inclusion of Ferrari as unconditional entrants is the agreement they had. The same agreement one presumes that included Ferrari’s technical veto. The same agreement the FIA said was no longer in force due to Ferrari signing on with FOTA. The same agreement the French courts recognised, in which case, the same agreement the FIA breached by forcing through these regulations.
The FIA appear to have very one-sided view of contracts – the other party is expected to honour their side, the FIA is not….
Why would anyone want to run in a series under those terms?
